These Terms of Service ("Terms") govern your access to and use of nxtweb. apps ("Service"), provided by nxtweb. Mateusz Lisowski NIP: 6793303074, based in Poland, Gromadzka 22c, 30-714 Kraków ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

2. Subscriptions & Billing

Paid plans are billed in advance on a recurring basis (monthly or annually) and automatically renew until cancelled.
Fees are non-refundable except where required by law or explicitly stated.
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
We may change pricing with at least 30 days' notice. Changes apply to the next renewal.

3. Acceptable Use

You agree not to:

Use the Service for unlawful, harmful, or abusive purposes.
Distribute malware, phishing content, or illegal material via shortened links or signatures.
Attempt to bypass rate limits, security, or access controls.
Reverse-engineer, scrape, or resell the Service without our written permission.
Impersonate any person or entity.

We may suspend or terminate accounts that violate these rules, with or without notice.

4. Your Content

You retain ownership of content you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate and improve the Service.

5. Intellectual Property

The Service, including its software, design, and trademarks, is owned by nxtweb. Mateusz Lisowski NIP: 6793303074, based in Poland, Gromadzka 22c, 30-714 Kraków and protected by intellectual property laws. No rights are granted except those expressly set out in these Terms.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Scheduled maintenance will be announced when feasible.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXTWEB. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100).

9. Indemnification

You agree to indemnify and hold nxtweb. harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles. Disputes shall be resolved in the competent courts of Poland, unless mandatory consumer law provides otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you via email or in-app notice. Continued use after the effective date constitutes acceptance.
